Terms of Service

1. The service
Inchat ("Inchat", "we", "us") provides an omnichannel customer-conversation platform: merchants connect their Facebook Pages, Instagram accounts, WhatsApp Business numbers, and website chat, and manage those conversations — with optional AI-assisted replies — from one inbox. These terms govern your use of the service. By creating a workspace or connecting a channel, you agree to them.
2. Your account and workspace
You are responsible for the accuracy of the information you provide, for safeguarding your login credentials, and for the actions of the teammates you invite into your workspace. You must have the authority to connect any Page, account, or phone number you connect to Inchat.
3. Acceptable use
You agree to use Inchat in compliance with applicable law and with the platform policies of the channels you connect — including Meta's Platform Terms, WhatsApp Business Messaging Policy, and Commerce Policies. You must not use Inchat to send spam or unsolicited messages, to harass, deceive, or defraud recipients, or to process categories of data prohibited by the connected platforms. We may suspend workspaces that put our platform access or other customers at risk.
4. AI-assisted replies
Inchat can draft or automatically send AI-generated replies based on the knowledge you provide. You control whether automatic sending is enabled and remain responsible for the messages sent from your channels, including AI-generated ones. AI output may contain errors — review your knowledge base and confidence settings before enabling unattended auto-reply.
5. Your data
You retain all rights to your data. We process it only to provide the service, as described in our Privacy Policy. Customer conversations are not used to train AI models. On termination, we delete workspace data from production systems within 30 days.
6. Fees
Paid plans are billed through Stripe on a subscription basis. Channel-level messaging fees (for example WhatsApp per-message pricing) are charged by Meta directly to your WhatsApp Business Account and are separate from Inchat's fees.
7. Availability and liability
Inchat is provided "as is" without warranties of any kind. We depend on third-party platforms (Meta, WhatsApp, hosting providers) whose availability we do not control. To the maximum extent permitted by law, our aggregate liability for any claim arising out of the service is limited to the fees you paid us in the three months preceding the claim.
8. Changes and termination
We may update these terms as the service evolves; material changes will be notified to workspace owners in advance. You may stop using the service and delete your workspace at any time. We may terminate or suspend access for breach of these terms, with notice where practicable.
9. Governing law
These terms are governed by the laws of Malaysia. Disputes are subject to the exclusive jurisdiction of the courts of Malaysia.
